1. PROMOTION DESCRIPTION: Garrett’s “Diggin’ with Jase Robertson” Giveaway (“Giveaway “) begins on 1/08/23 at 10:00:00 A.M. Pacific Standard Time (“PST”) and ends on 2/19/2024 at 11:59:59 P.M. PST (the “Promotion Period”). Sponsor’s computer is the official time keeping device for the Giveaway.

2. ELIGIBILITY: Giveaway is open only to individuals who are: (a) legal residents of the United States, (b) physically located in one (1) of the fifty (50) United States or the District of Columbia, and (c) at least the age of majority, as defined in the Entrant’s state of residence, or older at the time of entry. Void in Puerto Rico, outside the United States and where prohibited by law. All entrants must have a valid mailing address, email address and phone number. By participating in this Giveaway, Entrants agree to be bound by these Official Rules. Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees (the “Promotion Entities”), are ineligible to enter the Giveaway or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.

3. PRIZES: 

Two (2) winners will each receive:

• A day to dig with Jase Robertson and a small group on an historic site where artifacts dating to the 1800s could be found with a metal detector. Each winner will be allowed to bring one (1) detecting companion along with them for this detecting experience. Participants can bring their own Garrett metal detectors or request that Garrett provide detectors for their temporary use during the hunt period.
• Each winner is responsible for his/her travel to Monroe, Louisiana, on a date in early 2024, soon after the winners are announced. Garrett will provide $2,500.00 to each winner to assist with travel costs. These funds are specifically to cover the winner and winner’s companion out-of-pocket expenses for travel (i.e., vehicle expenses, airfare, hotel, meals, etc.).
• Garrett will also provide a $1,000.00 merchandise credit on Garrett Direct for each winner (can be shared by winner and companion). This credit can be used to order Garrett metal detectors, Pro-Pointers, or detecting accessories desired by the winner.
• Only one prize per person and per household will be awarded. Prizes cannot be transferred, redeemed for cash or substituted by winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The approximate retail value (ARV) of the prize represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty 
  concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items.
• Approximate retail value of each prize package is $3,500. The prize winner(s) is/are responsible for reporting and paying all taxes associated with a winner’s receipt of the prize. Winner must complete a W-9 form that Sponsor will use to file required 1099 forms with IRS.
• This giveaway is open to all United States residents and prizes will only be awarded and/or delivered to addresses within said country (see “Eligibility” section). All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize. 
   

4. HOW TO ENTER: All required steps specified herein are referred to as the “Entry,” and each person who submits one (1) or more Entries is an “Entrant.” (a) Enter by making a purchase of any item on the Garrett Direct website https://garrett.com/privacy-and-legal during the Promotion Period. (b) To Enter without making a purchase: visit the Garrett Direct website (https://garrett.com/store/) and click on the provided link to enter for free. (c) Total Entries: There is a limit of five (5) total Entries permitted per Entrant, regardless of method of Entry, during the Giveaway Period.

Participation constitutes Entrant’s full and unconditional agreement to these Official Rules, along with the Giveaway website terms and conditions, if any, and to be bound by Sponsor’s privacy policy and to all decisions of Sponsor, which are final in all matters related to the Giveaway and which Sponsor may decide in its sole discretion. Winning a Prize is contingent upon fulfilling all requirements set forth herein. PARTICIPATION IN THE GIVEAWAY IS VOLUNTARY AND DOES NOT REQUIRE YOU TO PURCHASE ANYTHING FROM SPONSOR.

By submitting an Entry, you agree that Sponsor may contact you via telephone, email, at your home address or on social media, including on Facebook, Instagram or TikTok, by sending you a direct message, tagging you, posting to your social media page or naming you on Sponsor’s social media pages.

Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/ giveaway subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period in order to participate. In the event of a dispute as to any Entry, the authorized account holder of the email address used will be deemed to be the participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential prize winner may be required to show proof to Sponsor of being the authorized account holder or forfeit the prize.

5. WINNER SELECTION: The Winner(s) of the Giveaway will be selected in a random drawing by Sponsor from among all eligible Entries received throughout the Promotion Period. One (1) potential prize winner will be selected from all entrants in a random drawing to be held on or about January 31, 2024, and a second drawing of one (1) potential prize winner will take place on or about February 19, 2024. The potential prize winner(s) will be notified within twenty-four hours. Failure by a potential prize winner to respond within twenty-four (24) hours after the second of two (2) attempts will result in disqualification and an alternate potential prize winner then will be selected in the same manner time permitting from all remaining eligible Entries.

Odds of winning will vary depending on the number of eligible Entries received. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account.

Prize winner and winner’s Guest must be able to travel on dates to be determined by Sponsor. Exact dates of travel to be determined at Sponsor’s discretion. All meals, ground transportation and incidentals not described herein and incurred by Prize winner and winner’s Guest will be the sole responsibility of the Prize winner and/or winner’s Guest, utilizing the Garrett travel allowance described in “Prizes” detail.

SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR  OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE PRIZE OR ANY OTHER ASPECT OF PRIZE WINNER’S OR GUEST’S ACCEPTANCE OR USE OF THE PRIZE.

6. VERIFICATION OF WINNER AND PUBLICITY: ALL POTENTIAL PRIZE WINNERS ARE SUBJECT TO 
VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE GIVEAWAY, INCLUDING THE ADMINISTRATION, OPERATION, SELECTION OF THE WINNER AND ALL OTHER MATTERS RELATED TO THE GIVEAWAY. AN ENTRANT IS NOT A WINNER OF A PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

Except where legally prohibited, potential Prize winner(s) must sign and return a Release of Liability and Publicity Release and any other related documentation required by the Sponsor (collectively, the “Release”), which will be included with the email notification, within seventy-two (72) hours following notification of winning, or an alternate potential Prize winner(s) may be selected. Sponsor reserves the right to disqualify any potential Prize winner who does not comply with these requirements and such disqualification will result in an alternate Prize winner(s) being selected.

No substitution or transfer of a prize is permitted except by Sponsor. This Publicity Release includes Winner(s) and detecting companion(s) agreeing to be photographed or filmed while with Jase Robertson and while metal detecting in the field with him. Such images may be used by Sponsor on Social Media and for other Marketing purposes, as further detailed in the paragraph that follows.

EXCEPT WHERE PROHIBITED BY LAW, PARTICIPATION IN THE GIVEAWAY CONSTITUTES ENTRANT’S GRANT TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR), AND THE RELEASED PARTIES THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLD WIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, THE ENTRANT’S ENTRY, NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING BUT NOT LIMITED TO HOMETOWN AND STATE) FOR ADVERTISING, TRADE, POINT OF PURCHASE MATERIALS AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.

7. GENERAL RULES AND RELEASES: All federal, state and local laws and regulations apply. BY PARTICIPATING IN THIS GIVEAWAY, ENTRANT AGREES THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS GIVEAWAY OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SUCH SITE. By participating in this Giveaway, Entrants agree to be bound by the Official Rules and the results of the random drawing. Sponsor is not responsible for any typographical or other error in the offering or the announcement of any Prize or in the administration of the Giveaway.

Sponsor is not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections, telephone transmission problems, or garbled transmissions or miscommunications; computer or software malfunctions, or damage to a user’s computer equipment (software or hardware); technical failures; or other errors or malfunctions of any kind whether human, mechanical, electronic, or otherwise. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If any provision of these Official Rules should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable.

8. LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Giveaway; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Giveaway; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Giveaway or download of any materials in the Giveaway.

If, for any reason, the Giveaway is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Giveaway.

PRIVACY: Any personal information sent to, shared with or collected by Sponsor in connection with the Giveaway is subject to the Garrett Privacy Policy, found at https://garrett.com/privacy-and-legal, and Entrant understands that the Entrant is providing such information to Sponsor. Sponsor and its agents, affiliates, subsidiaries, representatives or service providers may use Entrant’s personal information submitted with Entry for purposes of prize fulfillment, including sharing such information with any company that provides elements of the Prize in order to for the company to deliver the Prize element(s) , and/or for future marketing by Sponsor, such as to notify them of an event or Giveaway that Sponsor thinks may be of interest.
