- Purpose
Garrett is committed to providing high quality metal detectors and accessory products and superior after sales support. Garrett is proud of the global reputation and high brand value it has achieved in the metal detecting field along with its retailers and end-user consumers alike. Garrett actively supports the advertising and promotion of its products by its authorized sellers in the United States and Canada. In order to protect and enhance the image and reputation for quality associated with our products and associated trademarks, Garrett is unilaterally revising a minimum advertised price policy (“MAP Policy” or “Policy”) that applies to all advertisements by authorized resellers and retailers, including catalog and internet-only retailers, and other approved sellers (collectively, “sellers”) of Garrett products (collectively, “Garrett Products”) to end user consumers in the United States and Canada.
This Policy is effective July 1, 2023, and supersedes all prior Garrett policies or representations regarding minimum advertised prices for the Garrett Products applicable to its sellers. - Product Subject to Garrett’s MAP Policy
This Policy applies to advertisements for all Garrett Sport Products. This policy does not apply to Garrett’s security, thermal or countermine products. The Garrett MAP Policy will be made available to all sellers and may be amended by Garrett in its sole discretion at any time. - Minimum Advertised Price (MAP)
The “minimum advertised price” (“MAP”) is the lowest price at which the Garrett product may be advertised. Garrett is solely responsible for (1) establishing the MAP for each Garrett Product and (2) communicating the MAP to all sellers. This MAP Policy applies only to advertised prices and does not apply in any way to the retail price at which Garrett Products are sold or offered for sale to an Individual consumer. Sellers remain free to set the actual sales prices for Garrett Products at the sellers’ sole discretion and to communicate such actual sales prices to consumers through alternative (non-advertising) means. While sellers remain free to sell all Garrett Products at any price, it is a violation of this Policy for a seller to advertise any Garrett Product at a price lower than MAP. This MAP Policy does not establish maximum advertised prices; sellers may advertise and/or offer Garrett Products at any price more than the MAP for such Product. - Advertising and Advertisements
For purposes of this Policy, the terms “advertising” and “advertisements” include all promotional or pricing information of the Garrett Products displayed in any type of media, including, but not limited to: social media, websites, internet ads in a digital format, television, radio ads, blogs, mobile/smart phone applications, mobile ads, display ads, banner ads, sponsor links, paid search ads, pay-per-clicks, seller-initiated text messages or emails to any customer, newspapers, catalogs, magazines, flyers, brochures, or any other marketing or promotional materials, billboards, online though broadcast/media, product listings, and outdoor signing.
The terms “advertise”, and “advertisement” do not include, and this MAP Policy does not apply to:- Signage displayed within a brick-and-mortar selling location; and
- Pricing information displayed at the Final Online Checkout Stage, which is when the Garrett Product is put into a shopping cart that contains the customer’s name, shipping address, email address, and payment information of a transaction. Please note that pricing information in the “shopping cart” or the Final Online Checkout Stage must be obscured technically so that it is not retrievable by shopping and pricing engines and not displayed on search page results within the seller’s own website.
- Policy Violations
Advertisements that violate this Policy include, but are not limited to:- Offering coupons, banner discounts, discounts, rebates, membership discounts, or other inducements that, when applied, result in an advertised price lower than the MAP, including through use of a store wide sale (e.g., Buy One Get One Free or Buy One Get One Discounted), a department-wide sale, category-wide sale, website-wide sale (e.g., 25% off entire site), promotional code, or other similar provision that can be applied to the Garrett Products;
- Strikethroughs or strikeouts of pricing information, “see price in cart,” or other statements within an advertisement that suggest a lower price for a Garrett Product may be found at the Final Online Checkout Stage in such a manner that would effectively result in the Garrett Products being advertised at a price below the MAP Price;
- Permitting any third-party to alter the advertised price for any Garrett Product; and
- Direct or indirect attempts to circumvent this Policy.
- Bundling
- Bundling Garrett and non-Garrett products is not allowed.
- Setting a bundle price of multiple Garrett products below the combined MAP prices of the products in the bundle is not allowed unless the bundle has been authorized by Garrett.
- This Policy Is Not an Agreement and Is Non-Negotiable
This Policy does not constitute an agreement between Garrett and any other entity. Garrett does not solicit and will not accept any assurance of compliance with this Policy from any seller. Each seller must independently choose whether to comply with this Policy. This Policy is not negotiable and will not be altered for any individual seller. - Noncompliance
Garrett will take the following actions against any seller that fails to comply with this policy:
First Violation: Garrett will notify the seller in writing and email of such failure.
Second Violation: Garrett will notify the seller in writing and email of such failure and will immediately place the seller’s account on shipping hold for sixty (60) days. Garrett will revoke any pending orders, cancel any pending shipments, and not accept any new orders from the seller during this 60-day period.
Third Violation: Garrett will terminate its business relationship with the seller. Garrett will revoke any pending orders and cancel any pending shipments to the seller. This Policy will be enforced by Garrett in its sole discretion and without notice. Sellers have no right to enforce the Policy. The Garrett MAP Administrator is the sole decision maker regarding violations of the above polices. - Policy Administration
Garrett may suspend, revise, update, terminate, reinstitute, or modify this MAP Policy at any time in its sole discretion. Any such modifications will be made available to all authorized sellers. If Garrett changes the MAP on any Garrett Product, it will provide at least thirty (30) days’ notice to sellers before such a change takes effect.
No Garrett employee or agent is authorized to modify, interpret, or grant any exceptions to this Policy; solicit or obtain the agreement of any person or entity to comply with this Policy; or otherwise discuss any aspect of this Policy with any seller, including any seller’s compliance with the terms.
